STATE BOARD OF ELECTIONS AND ATTORNEY GENERAL’S OFFICE REVIEWING APPARENT CONFLICT BETWEEN STATE AND FEDERAL LAW

 

 

 

RICHMOND - The State Board of Elections is aware of a problem involving a conflict between State and federal law that has led to the denial of approximately 100 Federal Write-in Absentee Ballots (FWAB).

This problem occurs when the ballot is accompanied by an application but is not properly witnessed. The Code of Virginia has stated since 2002 that all FWABs serving simultaneously as an absentee ballot application and as an absentee ballot require both a witness’ signature and an address in order to be counted in the General Election.

The State Board of Elections is working with the Office of the Attorney General to conduct a detailed review of both laws to guarantee that no undue hardship is placed upon voters who use the Federal Write-in Absentee Ballot.

“Everyone involved is taking a closer look at both Federal and State laws to ensure that every effort is made to count the votes,” said State Board Secretary Nancy Rodrigues.

The State Board of Elections anticipates receiving legal counsel in time for the Board meeting that is scheduled for Tuesday, October 28 at 10AM.
